Terms and Conditions

1.1. The owner of the registration environment EXPEDITIONESTONIA.COM (hereinafter ExpeditionEstonia) is Estonian Adventure Racing Team MTÜ (registry code 80381708), with legal address Lossi 6-2, Tallinn.

1.2. ExpeditionEstonia mediates the Service Provider’s Service to Clients and / or Users through the Web Environment.

1.3. The prices of the services sold at ExpeditionEstonia are indicated next to the services. All prices of products sold in the online store are in euros.

1.4. To order the service, you must add the desired products to the shopping cart. The required data fields must be filled in to place an order. The screen then displays the amount of the fee, which can be paid securely through the following payment methods:

• Estonian banking links: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay

• Visa / Mastercard card payments

NB! When paying with a bank link, be sure to click the “Back to merchant” button on the bank’s page.

1.5. A registration confirmation with the entered data and payment information will be sent to the Customer for the confirmed order.

1.6. Payments are mediated by Maksekeskus AS. Payment takes place outside ExpeditionEstonia’s secure environment – when paying with a bank link in the secure environment of the respective bank and when paying with a credit card in the secure environment of Maksekeskus AS. The seller does not have access to the customer’s bank and credit card details. The agreement enters into force upon receipt of the amount due to the current account of ExpeditionEstonia.

1.7. The owner of ExpeditionEstonia is the chief processor of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

Validity of conditions and procedure for amendment

2.1. The General Terms and Conditions (https://expeditionestonia.com/en/terms-of-sale/) apply to all Clients, Users and Service Providers.

2.2. The price list is valid for all Customers. The Terms and Conditions of the Service Provider and the Price List apply to all Service Providers. The conditions established by the Service Provider apply to the Service User of the respective Service Provider;

2.3. All Terms and Conditions are available for viewing on the ExpeditionEstonia Web Environment;

2.4. ExpeditionEstonia has the right to unilaterally change and supplement the Terms and Privacy Policy at any time. The changes will be published in the ExpeditionEstonia Web Environment and will take effect upon the publication of the new terms and conditions in the Web Environment.

2.5. If ExpeditionEstonia has notified the Customer, the Service Provider and / or the User of the change of the Terms and the Customer, the Service Provider and / or the User does not agree to the change of the Terms, he has the right to cancel the Agreement by giving at least fourteen (14) calendar days notice of the change.

2.6. ExpeditionEstonia may terminate the Agreement with the User without prior notice if the User has materially violated these Terms or the Terms of Service of the Service Provider. The following, inter alia, are considered to be serious infringements:

2.6.1. The user has provided false information;

2.6.2. The User violates the obligations arising from the agreement entered into with ExpeditionEstonia;

2.6.3. The User violates the rules established by the Service Provider for consuming the Service;

2.6.4. The User abuses the web environment and endangers ExpeditionEstonia or other Users

Nature of the service and provision of the service

3.1. The Service Provider provides the rules for purchasing and consuming the Services in the Web Environment;

3.2. Having a user account in the Web Environment is free of charge;

3.3. Only the User has the right to purchase or initiate the use of the Service;

3.4. The advance payment is made in the manner described in the Web Environment, usually by bank link or by bank transfer to the service provider’s bank account;

3.5. If the User has purchased a ticket but is not provided with the Service for reasons arising from the Service Provider, the User has the right to return the funds in the value of the Ticket by the Service Provider;

3.6. If the User has purchased a Ticket and booked a time to consume the Service, but does not actually consume the Service, the Service Provider has the right to mark the Ticket used. In this case, the funds belong to the Service Provider;

3.7. The purchased Ticket can be withdraw 30 days before the event with a refund of 90% of the participation fee; 7 days before the event, receiving a refund of 50% of the participation fee; It is no longer possible to withdraw from the Ticket less than 7 days before the start of the event, but resale of the Ticket is permitted. Changes must be notified to info@expeditionestonia.com by e-mail, forwarding the name of the team and the current account to which the return should be entered. The money will be returned within 7 days.

3.8. The User Account is personal and the User has the sole right to use it. The User is prohibited from giving his / her User Account to other persons for use;

Protection, processing and direct marketing of personal data

4.1. ExpeditionEstonia owns the copyright to the ExpeditionEstonia web environment, including software, databases, and graphics;

4.2. ExpeditionEstonia suspends access to User Accounts containing incorrect data until the data is corrected. If the data is not corrected within fourteen (14) days after notifying the User, ExpeditionEstonia has the right to delete the User Account. The above applies to all accounts in ExpeditionEstonia;

4.3. In case of suspicion of a fraud scheme, ExpeditionEstonia has the right to close the account related to the suspicion and suspend transactions;

4.4. The principles of personal data processing, which are available on the website https://expeditionestonia.com/Home/Privacy, are applied to personal data collected in the online environment and in connection therewith.

User rights and obligations

5.1. The User undertakes to follow the conditions of use of the Service established by the Service Provider;

5.2. Violation of the rules established by the Service Providers is the responsibility of the User who committed the violation, not ExpeditionEstonia;

5.3. The User undertakes to keep the access to the User Account known to him / her and in case of access by third parties to notify ExpeditionEstonia immediately;

5.4. The User has the right to the Service if he has purchased a Ticket;

5.5. The user submits true data to ExpeditionEstonia and monitors on an ongoing basis that the submitted data is up-to-date. The user is responsible for the accuracy of the data provided.

Obligations and responsibilities of the parties

6.1. When providing the Service, the parties to the transaction are the User and the Service Provider;

6.2. ExpeditionEstonia is not responsible for the fulfillment of obligations arising from the agreement concluded between the Service Provider and the User;

6.3. ExpeditionEstonia shall not be liable for any damage caused to the Users during the use of the Service (for example: injuries, medical expenses), as well as for property damage (for example: loss or theft of personal belongings);

6.4. The user must provide the ExpeditionEstonia with true data and monitor on an ongoing basis that the submitted data is correct.

6.5. After placing the order, the buyer has the right to withdraw from the contract under the conditions specified in the competition instructions of the purchased service provider.

6.6. The service provider has the right to withdraw from the sales transaction and demand back the ordered service from the buyer if the price of the order in the online store is marked below its actual price due to a mistake.

Force majeure

7.1. The Parties shall be released from the obligations arising from and related to the Agreement in part or in full during the period when it is prevented by force majeure, the Parties being obliged to take all measures to prevent damage to the other Party and ensure the performance of the Agreement as much as possible. The existence of force majeure must be proved by the Party wishing to refer to the circumstances of force majeure as a basis for releasing the liability arising from legislation or provided for in the Agreement for non-performance or improper performance of obligations under the Agreement.

7.2. The other Party shall be immediately notified in writing of the occurrence of force majeure.

7.3. In the event of force majeure, all terms provided for in the Agreement shall be extended by the period of occurrence of the specified circumstances. In the event of force majeure lasting more than 1 calendar month, the Parties have the right to cancel the Agreement

Other conditions

8.1. The Parties may not transfer the rights and obligations arising from the Agreement to a third party without the written consent of the other Party;

8.2. All notices given by the Parties related to the Agreement shall be in a form that can be reproduced in writing;

8.3. In the performance of the Agreement and in the event of disputes arising from the Agreement, the legislation of the Republic of Estonia shall be followed;

8.4. Disputes arising from the agreement shall be resolved by agreement of the Parties. If no agreement is reached, disputes will be settled in Harju County Court;

8.5. The Agreement shall be deemed concluded if the User has confirmed in the ExpeditionEstonia Web Environment that he / she agrees to the terms and conditions of this Agreement. After confirmation, the User will receive a confirmation letter on his / her e-mail, which contains the information provided during registration together with payment information.
